Digital Millennium Copyright Act ("DMCA") Overview

The DMCA provides a framework for addressing copyright infringement claims regarding content on our Platform.

Filing a Copyright Complaint

If you believe that your copyrighted work has been used on our Platform without proper authorization, you may submit a DMCA takedown notice. To ensure prompt processing, please provide the following information:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Clear identification of the copyrighted work claimed to be infringed

Important Considerations

  • Accuracy: All DMCA notices must be submitted under penalty of perjury. False claims may result in legal consequences.
  • Investigation: We encourage you to thoroughly investigate and consult legal counsel before submitting a takedown notice.
  • Direct Contact: Consider reaching out to the user directly before filing a formal DMCA notice.
  • No Automated Submissions: We do not accept automated or bulk DMCA notices. Each claim requires individual review.

Counter Notices

Users whose content has been removed may submit a counter notice if they believe the content was wrongly disabled. Counter notices must include:

  • Your physical or electronic signature
  • Identification of the removed content and its former location
  • A statement under penalty of perjury that you have a good faith belief the material was wrongly removed
  • Your contact information and consent to local federal court jurisdiction

Processing of Notices

NovaWrite will:

  • Review all properly submitted notices
  • Remove content that is properly identified as infringing
  • Notify affected users of the removal
  • Forward a copy of the DMCA notice to the affected user
  • Restore content within 14 days of receiving a valid counter notice, unless we receive notice that legal action has been filed
